1. Agreement to Terms
By accessing or using the WACMN Whirlpool Hub ("the Platform", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
2. Description of Service
The WACMN Whirlpool Hub is a professional networking and collaboration platform that enables users to:
- Create and manage user profiles
- Create and participate in discussion boards
- Share posts, images, and documents
- Connect with other users
- Create and manage events
- Receive notifications and communications
3. Eligibility
3.1 Age Requirement
You must be at least 13 years of age to use the Platform. If you are under 18 years of age, you must have the consent of your parent or legal guardian to use the Platform.
3.2 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.3 One Account Per Person
You may only create one account. Creating multiple accounts may result in termination of all your accounts.
4. User Content
4.1 Your Content
You retain all rights to the content you post on the Platform ("User Content"), including posts, comments, images, documents, and profile information.
4.2 License to Us
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your User Content on the Platform and to create derivative works (such as AI-generated summaries).
4.3 Content Restrictions
You agree not to post User Content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Infringes any intellectual property rights or other rights of any person or entity
- Contains viruses, malware, or other harmful code
- Violates any applicable laws or regulations
- Contains personal information of others without their consent
- Is spam, unsolicited advertising, or promotional material
- Impersonates any person or entity
5. Board Management
5.1 Board Ownership
Users who create boards ("Board Owners") have the right to:
- Manage board settings and privacy
- Invite or remove users from their boards
- Delete their boards
- Moderate content on their boards
5.2 Public vs Private Boards
- Public Boards: Visible to all users; any user with access can view and post (based on board settings)
- Private Boards: Only visible to invited users; Board Owner controls access
6. Acceptable Use
You agree not to:
- Violate any laws or regulations
- Infringe on the rights of others
- Harass, abuse, or harm other users
- Distribute spam or unsolicited messages
- Attempt to gain unauthorized access to the Platform or other users' accounts
- Interfere with or disrupt the Platform's operation
- Use the Platform for any illegal or unauthorized purpose
- Collect or harvest personal information of other users without consent
- Impersonate any person or entity
- Post false or misleading information
7. File Uploads
7.1 Permitted File Types
- Images: JPEG, PNG, GIF, WebP (max 10MB)
- Documents: PDF, Word, Excel, text files (max 10MB)
7.2 File Storage
Files are stored securely in Amazon S3. Files are automatically deleted when associated boards or posts are deleted.
8. AI-Powered Features
8.1 Board Summaries
The Platform offers AI-powered board summarization using OpenAI. By using this feature:
- You consent to your board content being processed by OpenAI
- You acknowledge that AI-generated summaries may not be 100% accurate
- You agree to OpenAI's terms of service and privacy policy
8.2 No Liability for AI Content
We are not responsible for the accuracy, completeness, or reliability of AI-generated content. Use AI features at your own risk.
9. Disclaimers
9.1 "As Is" Basis
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9.2 No Professional Advice
The Platform is for informational and networking purposes only. It does not constitute professional advice. You should consult appropriate professionals for specific advice.
9.3 User Interactions
We are not responsible for the conduct of any user or the content posted by users. You agree to take reasonable precautions in all interactions with other users.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE PLATFORM.
10.1 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
11. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason including breach of these Terms. You may terminate your account at any time through your account settings.
Upon termination, your right to use the Platform will immediately cease and your User Content may be deleted (except as required by law).
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia.
12.2 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts of Western Australia for any disputes arising out of or relating to these Terms or the Platform.
12.3 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally within 60 days.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Updating the "Last Updated" date
- Posting a notice on the Platform
- Sending an email notification (for significant changes)
Your continued use of the Platform after changes to these Terms constitutes acceptance of the new Terms.
